Terms of Service

Effective September 5, 2026

These Terms govern access to SwitchLens, a service operated by SwitchCase Studios LLC (“SwitchLens,” “we,” or “us”). If your organization has a signed agreement with SwitchCase Studios LLC, the signed agreement controls where it conflicts with these Terms.

1. Accepting these Terms

By creating an account, accepting an invitation, purchasing a plan, or using the service, you agree to these Terms and the Privacy Policy. You must be at least 18 and able to form a binding contract. If you use SwitchLens for an organization, you confirm you are authorized to accept these Terms for it.

2. The service

SwitchLens connects approved databases and tabular files, models source metadata and relationships, builds reports and individual visualizations, schedules eligible refreshes, and publishes controlled visualization embeds. Features and limits vary by plan. Documentation and the in-product plan summary describe current behavior; roadmap items are not commitments.

3. Accounts and workspaces

Keep account credentials and devices secure, provide accurate account information, and promptly report suspected misuse. Workspace roles grant different powers to view data, build content, or administer members and sources. The customer is responsible for assignments made by its administrators and for removing access when it is no longer appropriate.

4. Customer Content and connected systems

You retain ownership of Customer Content. You give SwitchLens a limited right to host, copy, query, transform, cache, transmit, and display it only as needed to provide, secure, and support the service or comply with law. You represent that you have the necessary rights and authority to connect each system and process the selected data.

You are responsible for source accuracy, lawful collection, backup of source data, connector permissions, and deciding which information belongs in a report or embed. SwitchLens is not a system of record and is not professional, financial, legal, or compliance advice.

Unless a signed agreement expressly permits it, do not submit protected health information, payment-card or authentication data subject to specialized security standards, government identification numbers, or other regulated or highly sensitive data that requires controls the service has not agreed to provide.

5. Embeds and sharing

Authors can publish individual visualizations publicly or to supported private audiences, subject to plan and product limits. A public embed uses a bearer URL: anyone who obtains it may be able to view the cached visualization. Private audience rules reduce access but cannot retract information already viewed, copied, exported, or captured. You are responsible for selecting an appropriate audience and for the website or application where an embed appears.

6. Acceptable use

You may not use SwitchLens to violate law or third-party rights; access systems or data without authorization; distribute malware; evade security or usage limits; probe or disrupt the service; expose another person's credentials; reverse engineer the service except where law permits; or use the service to build or train a competing product through automated extraction. Do not submit data whose processing requires controls or contractual terms that have not been agreed.

7. Third-party services

SwitchLens depends on third-party identity, cloud, database, communication, and payment providers and can connect to customer-selected systems. Their services, terms, availability, and changes are outside SwitchLens's direct control. You remain responsible for your third-party accounts and permissions.

8. Plans, billing, and taxes

Free, Team, and Business plans have the prices and limits shown before purchase. Paid plans are recurring monthly subscriptions billed through Stripe until canceled. Authorized billing owners can manage eligible subscriptions through Stripe's hosted Customer Portal; cancellation ordinarily takes effect at the end of the current billing period unless checkout or an order states otherwise.

Fees are non-refundable except where required by law or expressly stated in an order. Displayed prices are in U.S. dollars and exclude taxes unless checkout or an order states otherwise. Each customer and the service provider remain responsible for their obligations under applicable tax law. We may change a recurring price for a future renewal after reasonable advance notice; you may cancel before the new price takes effect.

9. Service changes

We may change, add, or remove features and limits and may discontinue the service. Where reasonably practical, we will provide notice of a material change that significantly reduces a paid plan's core functionality. Preview, beta, and roadmap features may change without notice.

10. Suspension and termination

We may suspend or limit access to protect the service or others, respond to legal requirements, address nonpayment, or investigate a material breach. You may stop using the service at any time and may cancel an eligible paid plan through the available billing flow. Before access ends, export any content you need using available product functions; complete account export and deletion automation is not currently offered.

11. Ownership and feedback

SwitchLens and its licensors own the service, software, designs, and documentation, excluding Customer Content. Subject to these Terms, you receive a limited, non-exclusive, non-transferable right to use the service during the applicable account term. If you provide feedback, you permit us to use it without restriction or compensation.

12. Disclaimers

To the maximum extent permitted by law, the service is provided “as is” and “as available.” We disclaim implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee uninterrupted or error-free operation, permanent retention, a particular business result, or that generated reports are complete or correct. Some jurisdictions do not allow certain disclaimers, so they may not fully apply to you.

13. Limitation of liability

To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, goodwill, or data. SwitchLens's total liability arising from the service will not exceed the greater of the fees paid for the service during the 12 months before the event giving rise to the claim or $100. These limits do not apply where prohibited by law or to liability that cannot legally be limited.

14. Indemnity

If you use SwitchLens for an organization, that organization will defend and indemnify the service provider from third-party claims arising from its Customer Content, connected systems, embeds, or unlawful use, except to the extent caused by the provider's breach of these Terms or unlawful conduct.

15. General terms

You may not assign these Terms without written consent, but the provider may assign them with a merger, reorganization, sale of assets, or transfer of the service. Neither party is responsible for delay caused by events beyond reasonable control. If one term is unenforceable, the rest remain effective. Failure to enforce a term is not a waiver.

Michigan law governs these Terms without regard to conflict-of-law rules, except that mandatory consumer protections and other rights that cannot legally be waived still apply. A court proceeding must be brought in the state courts located in Macomb County, Michigan, or the federal courts serving that county, and each party consents to that jurisdiction and venue. The parties should not rely on this page as a substitute for a negotiated data-processing agreement or sector-specific terms.

These Terms, the Privacy Policy, the applicable order or checkout terms, and any signed agreement are the entire agreement for the service and supersede prior discussions on the same subject. Sections concerning payment obligations, ownership, disclaimers, liability, indemnity, and general terms survive termination to the extent their nature requires.

16. Changes and contact

We may update these Terms and will change the effective date. Material changes will be communicated through the service or account relationship when reasonably practical. Questions and legal notices may be sent to jschroeder@switchcasestudios.com or mailed to:
